Buhari loses first round *Tribunal says, Osinbajo would rise and fall with President

The Court of Appeal sitting as the Presidential Election Petition (PEPT) in Abuja, has thrown out the preliminary objection, seeking to strike out the petition of former Vice President, Atiku Abubakar and the presidential candidate of the Peoples Democratic Party (PDP), seeking to nullify the election of President Muhammadu Buhari on February 23, 2019.

In a unanimous ruling on the objection of the President on the ground that Vice President, was not joined in the petition, the tribunal, held that since Buhari who nominated him was the respondent, the non-joinder of the Vice President did not fatally injure the case.

The court held that the position of a Vice President was not a necessary party in an election petition, as they were just an appendage to the candidate who would naturarlly rise and fall with the candidate, adding that Osinbajo was just an interested party and not a statutory party.
