Even though the Presidential Election Petition Tribunal, unanymously dismissed the motion of the presidential candidate of the Peoples Democratic Party (PDP), in the February 23 election, Atiku Abubakar that Zainab Bulkachuwa, should not preside over his petition against President Muhammadu Buhari, the President of the Court of Appeal, has quit the panel all the same.

But she did on the strength of what she termed “personal reasons” and not on the allegation of likelihood bias which Atiku and the PDP, raised as a result of her alleged link with the APC.

At the sitting in Abuja, on Wednesday after the issue was canvassed by both lawyers of the PDP and APC, who later agreed that she should recuse herself from the case, the tribunal in a unanymous ruling, held that the fact that her husband won the last senatorial election under the ruling party and her son contested the governorship election, were not sufficient grounds for her not to hear the case.

The tribunal held that neither her husband nor her son was a party in the case and that they were not also witnesses and therefore there was nothing strong enough to bar her or cast doubts in the minds of reasonable people as to the quality of her judgement in the matter.

However, Bulkachuwa, waited for the judgement to be delivered before deciding to step down, saying now she had allowed the position of the law to be stated, she was going to recuse herself for personal reasons.

“I have allowed the ruling on the application urging me to recuse my membership of the tribunal to test the position of the law,” she said.

“Now that the application has been dismissed on account of incompetence, I hereby announce my withdrawal from the panel.

“The remaining four members of the panel would remain while step would be taken to appoint my replacement.’’

The PDP and Abubakar had based their application, among other things, on the ground that Justice Bulkachuwa is the wife of Mr Adamu Bulkachuwa a prominent card-carrying member of the All Progressive Congress and Senator-elect for Bauchi north senatorial district which is a political party involved in the suit.

However, in delivering the lead ruling on the application, Justice Peter Ige, said not enough materials had been presented before the court to show that Justice Bulkachuwa will be biased in the hearing and the decisions on the petition.

Justice Ige added that the fact that she is married to a Senator-elect who along with her son are in the APC will not foist any room for bias in the case.

Stressing that her relationship is not capable of prejudicing the case, Justice Ige concluded that the petitioners have not satisfied the requirements for the president of the tribunal to recuse herself.
