EFCC-Fayose’s legal battle begin *Obanikoro, star witness *Ozekhome lead ex-gov’s legal team

The epic legal battle between former Governor of Ekiti State, Ayo Fayose and the Economic and Financial Crimes Commission, would open in Lagos in a matter of hours, with both sides armed to the teeth with all the legal arsenals.

Human rights lawyer, Mike Ozekhome, SAN, is expected to lead some other prominent lawyers including senior advocates to launch a move to first free the former governor from the detention of the anti-graft agency.

He is expected to apply for bail for Fayose, who personally submitted himself to the EFCC Abuja office in Wuse, Zone 2 on Tuesday, October 16, as he had promised, a fact, which his lawyers are already basing their arguments for bail on.

They are expected to persuade the court that a man with such pedigree who freely submitted himself to the authorities, in spite of the risks arising from several threats from the agency, was not likely to jump bail.

The EFCC, intent on securing a conviction, seems not to be relenting, as achieving such a goal is sure to boost its anti-graft war, as Fayose is considered as a very big fish for several reasons.

Already, they have secured the assistance of former Minister of State for Defence, Musiliu Obanikoro, who is central to the allegation against the governor, to testify as the star, state witness.

The Punch, is also reporting that the commission has assembled 21 other witnesses outside Obanikoro to testify Fayose, who is being tried for receiving N1.3billion from former National Security Adviser (NSA), Sambo Dasuki, who is currently in detention.

Obanikoro, was said to have received a slush fund totalling N2.2billion and distributed same, N1.3billion apiece to both Fayose and his then Osun State counterpart, Iyiola Omisore.

While Fayose succeeded in getting into power, Omisore, who recently went into a working agreement with the All Progressives Congress (APC) to deliver the state when the September 22 governorship election, went into a rerun, did not succeed.

Media reports also say that the former Deputy Governor of Osun State and a Senator, had his passport initially seized, returned alongside that of Obanikoro, who was initially detained on the same allegation, and had since defected from the Peoples Democratic Party (PDP), under which he became a minister to the APC.

Among the witnesses lined up to testify against Fayose, outside Obanikoro, according to Punch, is former Group Managing Director of Diamond Bank Plc, Mr Alex Otti and one Ayotunde Owope, said to be Fayose’s account officer, who opened the accounts and who “will give evidence on how funds were transferred from one account into another.”
