BREAKING: Let Kanu go, court orders *Says detention illegal

It took fear, sorrow, sweat, tears and blood, weeks of street demonstrations, then remonstrations, wise counsels, national and international interventions and finally - sense - all culminating in the eventual freedom of the leader of the Indigenous People of Biafra (IPOB), Nnamdi Kanu.       

The freedom of the Director of Radio Biafra from the hands of the Department of State Service (DSS), was ordered by Justice Adeniyi Ademola, of the Federal High Court, Abuja, on Thursday morning, bringing to an end a phase in what many believe is a keg of gunpowder capable of igniting a replication of the civil war Nigeria came out from more than 40 years ago.  

With the court holding that Kanu’s continued detention was unlawful, a journey that began a day earlier, when on Wednesday, Justice Shuaibu Usman of the Magistrate Court,  Wuse Zone 2, Abuja, discharged the pro-Biafran leader, on all counts of criminal conspiracy, intimidation and leading an unlawful society brought against him by the federal government. This was on the ground of the withdrawal of the case at the lower court for a higher court, which has jurisdiction to entertain charges bordering on terrorism, to take over.



The magistrate court, which had first heard the case immediately after Kanu was arrested in Lagos, had ordered his arrest, which was flouted by the DSS, which then filed another case before Justice Ademola, where they obtained an order to detain him for 90 days, a position Kanu’s lawyers argue has no place in the Nigerian law.

Ademola’s order today, may see to the turning of a new page not only in Kanu’s case, but in the entire agitation for a separate state of Biafra, which failed about 40 years ago, but which has been resurrected by the people of the South East and South South, on the ground of grand marginalisation unleashed against them by the Nigerian state.
